These terms

These terms are an agreement between you and Bot Hero, LLC, a Massachusetts limited liability company that does business as BotHeroGames ("we," "us"). They cover this website and the Twin Drift game for iOS and Android. By using the website or playing the game, you agree to these terms; if you don't agree, please don't use them.

No accounts, no submissions

Twin Drift's website has no visitor accounts and accepts no content or data submissions of any kind — there is no interface through which to submit anything.

Who can play

You must be at least 13 years old to use the website or play the game; Twin Drift is not directed to anyone younger than 13. If you are under 18, you should have a parent or guardian's permission to play.

Your license to play

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and play Twin Drift on a device you own or control, for your own non-commercial entertainment. The game is licensed to you, not sold. Under this license you may not:

  • copy, modify, translate, reverse-engineer, decompile, or make derivative works of the game or website;
  • sell, rent, lend, sublicense, or redistribute them;
  • cheat, use bots, exploits, or modified builds, or interfere with how the game or website works;
  • remove or alter any copyright, trademark, or other notice;
  • use the game or website in any way that breaks the law.

On iOS

On iOS, your copy of Twin Drift is also covered by Apple's standard Licensed Application End User License Agreement; we have not replaced it with a custom one. If Apple's agreement and these terms disagree about your iOS license, Apple's agreement controls.

Ads and purchases

Twin Drift is a free download that shows occasional ads between levels. Those ads come from third-party ad networks; we don't control or endorse what they advertise, and being offline simply means no ads appear. Nothing is sold in the game today, and no content is locked behind ads. A single one-time purchase that removes ads is planned but not yet offered; if it ships, it will be made through the App Store or Google Play, which handle payment, receipts, refunds, and restoring purchases under their own terms, and it will be a license to an ad-free version of the game with no cash value that can't be exchanged or transferred.

Your progress

The game stores your progress only on your device. There is no account and no cloud save, so if you delete the game or lose the device, that progress is gone and we can't restore it.

Ownership

Twin Drift's game, name, art, and this website's content belong to Bot Hero, LLC. They are protected by copyright and trademark law, and these terms give you no rights in them beyond the license above. Please don't copy, redistribute, or repackage them without asking us first.

Updates and changes to the game

We may update, change, or stop offering the game or website at any time, including adding or removing levels or features, and we may stop supporting older devices or operating-system versions. We'll try not to break anything, but we don't promise the game will stay available forever.

No warranties

The website and game are provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent the law allows. We don't promise they will be error-free or uninterrupted. Some jurisdictions don't allow these exclusions, so some may not apply to you.

Limits on our liability

To the fullest extent the law allows, Bot Hero, LLC is not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data or lost game progress, arising from the website or game. Our total liability to you for all claims together is limited to the greater of the amount you paid us for the game in the twelve months before the claim or fifty US dollars (US$50). Nothing in these terms limits liability that can't be limited by law.

Your responsibility

If your breach of these terms leads to a claim against us, you agree to cover the reasonable costs, including legal fees, that we incur because of it.

Ending this agreement

You can end this agreement at any time by deleting the game and no longer using the website. We can end your license if you break these terms. The sections on ownership, warranties, liability, and disputes, together with this section, survive termination.

Governing law and disputes

These terms are governed by the laws of the Commonwealth of Massachusetts and the Federal Arbitration Act, without regard to conflict-of-law rules. If you have a dispute with us, email our support address first and give us 30 days to try to resolve it informally. Any dispute we can't resolve that way will be settled by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, on an individual basis only — you and we each waive the right to a jury trial and to bring or join a class, collective, or representative action. Either of us may instead bring an individual claim in small-claims court. You can opt out of arbitration by emailing our support address within 30 days of first accepting these terms, stating your name and that you opt out; if you do, disputes will be heard in the state or federal courts located in Massachusetts, and you consent to their jurisdiction.

Changes to these terms

We may update these terms from time to time. The current version, with its effective date, is always published on this page; continuing to use the website or play the game after a change means you accept the updated terms.

Everything else

These terms are the entire agreement between you and us about the website and game. If any part is found unenforceable, the rest still applies. If we don't enforce a term, we can still enforce it later. You may not transfer this agreement; we may transfer it to a successor of our business.
